Railing “Limited” Warranty

The Manufacturer warrants that under conditions of normal use its “Perma Deck & Rail Railing System” will be free from defects in the structure and welds for 5 years and the “Perma Deck  Powder Coated Finish” will not crack, peel, flake or blister for 5 years.

5 YEAR WARRANTY LIMITATIONS: 

This warranty does not cover damage due to normal weathering, chalking, scratching, fading, corrosive atmosphere contaminants (ie. Chemical fumes, pollution, acid rain) volcanic ash, lightning, windstorms, tornadoes or any other act of god, explosions, riots, war, misuse or abuse, or other causes beyond the control of the company.

This warranty does not include any screws or other fasteners, any PVC components or glass used in the assembly or installation of the railing.

The company will not be required to honor this warranty if the installation has been modified, altered or changed in any manner at time of installation or there after, if the railing has not been installed by an authorized Perma Deck & Rail Contractor or from any damage or claim resulting from movement or any change to the structure on which the products are installed.

The company will not be required to honor this warranty without being given a reasonable opportunity to have its’ representative investigate any claim made.  If after investigating the claim, the company determines the claim is valid, the company’s sole liability and the owner’s only remedy shall be as follows:

The company may choose to either repair or replace any of the railing which is deemed defective by the company.  The cost of labour and materials to repair or replace the railing only are warranted, any other incidental costs are excluded specifically. 

All claims of alleged defects must be submitted in writing within 14 days of discovery thereof addressed to the company at Bay 10, 5935-35th Street SE, Calgary, AB T2C 2H1 and must include a copy of this document.

This Limited Warranty states the entire liability of the company.  Any implied warranty of fitness for a particular use is specifically excluded and disclaimed by the company.  Under no circumstances will the company be responsible or liable for loss of use of the said railing or any incidental or consequential damages arising out of negligence, breach of this limited warranty or any implied warranty, and such are specifically excluded from this warranty.
